Terms of Service

1. Who we are

The Service is operated by Amine EL KERZAZI, an individual sole operator established at 90 rue Abbé Pierre Arnaud, APT 1, 85000 La Roche-sur-Yon, France (“macroBody”, “we”, “us”). 2. Acceptance of these Terms

By tapping “I agree”, creating an account, or otherwise using the Service, you confirm that you have read, understood and accept these Terms and the Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of someone else, you confirm you are authorised to accept these Terms for them.

3. Eligibility

You must be at least 16 years old (or the minimum age of digital consent in your country) and able to form a binding contract. The Service is intended for general wellness and is not designed for children. If you are under the applicable age, please do not create an account.

4. The Service

macroBody is a nutrition-tracking and adaptive coaching tool. It lets you set goals, log foods (by search, barcode scan, AI photo recognition, or manual/quick entry), track weight and macronutrients, and receive calorie and macro targets that adapt over time based on the data you enter. Targets and expenditure figures are estimates generated by formulas and statistical models — they are not guarantees of any result.

5. Health disclaimer — not medical advice

macroBody does not provide medical, nutritional, or healthcare advice and is not a medical device. The Service is for informational and self-tracking purposes only and is no substitute for professional advice. Always consult a qualified physician or registered dietitian before starting any diet, weight-loss, or exercise program, particularly if you are pregnant or breastfeeding, under 18, elderly, or have (or are at risk of) any medical condition, including diabetes, heart conditions, or an eating disorder. If you are struggling with disordered eating, please seek professional help. You use the Service and rely on its estimates at your own risk.

6. Your account

You must provide accurate information and keep your login credentials confidential. You are responsible for activity under your account. You may sign in with email and password or with a third-party provider (e.g., Google). Tell us promptly at support@macrobody.fr if you suspect unauthorised use.

7. Subscriptions, free trial & billing

macroBody offers a free trial and paid subscription plans. Purchases are made and managed through the Apple App Store or Google Play, under their terms — we do not receive or store your payment-card details. Subscriptions renew automatically for the chosen period unless cancelled at least 24 hours before the period ends; manage or cancel renewal in your App Store / Google Play account settings. New accounts may also receive a complimentary limited free-logging window. Prices are shown in the app and may change with notice; statutory consumer withdrawal/refund rights are governed by the relevant app store and applicable law.

8. Your content and the shared food database

You keep ownership of the data you enter (“User Content”), such as your logs and profile. To run the Service we need a limited licence to host and process that data — see the Privacy Policy.

Shared food catalog. When you add or scan a food or product barcode that is not yet in our catalog, the product information you contribute — such as the barcode, product name, brand and nutrition facts — is added to our shared food database so that you and other users can find and log that product without re-entering it. You grant macroBody a worldwide, royalty-free, perpetual licence to store, reproduce, adapt and make this product information available within the Service. This contributed product data is not personal data and is not linked to your identity for other users. You agree only to contribute information you believe to be accurate and that you are entitled to share, and not to upload unlawful or infringing content.

9. Acceptable use

You agree not to: use the Service unlawfully or for anyone else’s detriment; copy, scrape, or harvest data from the Service; reverse-engineer, decompile, or attempt to extract source code except as permitted by law; interfere with or overload our systems; circumvent security, access controls, or usage/entitlement limits; or resell or commercially exploit the Service without our permission.

10. Intellectual property

The Service — including the app, website, software, design, “macroBody” name and logo, and all related content (excluding your User Content and third-party data) — is owned by macroBody or its licensors and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial use, subject to these Terms.

11. Third-party services and data

The Service relies on third parties, each governed by its own terms and privacy policy: food databases (USDA FoodData Central, Open Food Facts, FatSecret), sign-in and AI providers (Google), email delivery (Resend), the Apple App Store and Google Play, and hosting/infrastructure providers. Food and nutrition data sourced from third parties may contain errors; we provide it “as is”. We are not responsible for third-party services or content.

12. Suspension and termination

You may stop using the Service and delete your account at any time (in the app, or by emailing us). We may suspend or terminate your access if you breach these Terms, misuse the Service, or where required by law. On termination, your right to use the Service ends; provisions that by their nature should survive (e.g., the licence to contributed product data, disclaimers, and liability limits) will survive.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted/error-free operation. We do not warrant that the estimates, targets, or food data are accurate or complete.

14. Limitation of liability

To the extent permitted by law, macroBody is not liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, or health outcomes arising from your use of the Service. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded — including liability for death or personal injury caused by our negligence, for fraud, or under your mandatory statutory consumer rights, which remain unaffected.

15. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here with a new “last updated” date and, for material changes, give reasonable notice (e.g., in the app). Continued use after changes take effect means you accept the updated Terms.

16. Governing law and disputes

These Terms are governed by French law, without prejudice to mandatory consumer-protection rules of your country of residence. Disputes are subject to the competent courts; where you are a consumer in the EU, you may also use the European Commission’s Online Dispute Resolution platform.
